I will be the first lawyer to complain about clients borrowing money with their settlement proceeds as collateral. We had some bad experiences with some of the national funding companies because they extended too much credit and charged outrageous interest. No matter how much we warned clients they were either upset when their case settled or forced us to trial.

We still discourage borrowing money, but this industry is here to stay and we risk losing a client if we are not on board. As a result, we use Capital Financing and that is the ONLY loan company we allow our clients to borrow from with their settlement as collateral. Folks at Capital have a good formula for assessing at what point the case becomes “overfunded” and prevent that from occurring. This greatly reduces our problems with the loan industry.

One of the things I like best about Capital is their team will talk with our clients so no one at our Firm appears to be “holding up” client’s loan. Folks at Capital thoroughly investigate the case and communicate with our office about what should or should not be done with respect to credit. In fact, Capital has helped us a few times where we valued the case a bit higher than it should have been valued as Capital is witnessing settlements across the industry so Capital is a good measure of ultimate case value.

The motto around our office is “don’t borrow money” but, if you do, borrow from Capital.
